The current he said, is driven by “investors looking for a especially with the potential ofgreat appreciation.
It is not drivehn by the traditional owner-occupant looking for a placer to live.” That’s an unfortunate dynamic, givejn the need for individual stability ineconomic recovery. “Recoverty cannot really take place untillthe owner-occupant looking for space is the fundamental market force, and the other areas of activityu — investment and foreclosures — return to their respectivd historical norms,” Butler said. • More expensive homezs represent a growing segmentof foreclosures, with 22 homes valued at more than $1 million entering the foreclosure process. Seven of thoswe are valued at morethan $2 million.

New law increases court fees in Florida - Tampa Bay Business Journal:

hustenuejib1630.blogspot.com
Senate Bill 1718 increases the $295 filingg fee on all civil actions, suits or proceedings in circuity courtsto $395. Foreclosure case fees will now be baserd on asliding scale, ranging from $395 to depending on the value of the property or mortgager claim. The new fees are intended to produce revenue for the amove that’s getting mixes reactions from local attorneys. At issuee is the fact that $80 of the fees from all types of cases will go tothe state’s generap revenue fund, which can be used for anything. In the fees charged by the court systenm typically funded onlyjudicial programs. there were about 385,30o9 foreclosures in 2008, which woulde have translated into $30.
8 million had the fee been in placelast year. “The basic problem here is the Legislature is usingh the judicial system as a funding sourcefor non-judiciaol programs,” said John Fisher, an attorney with Orlando-basedc . The bill’s fee changes also come at a time when foreclosuree are atan all-time high in Florida, whicb ranks No. 1 in the United States in foreclosurew inventory, the said. The change could leaver lenders witha “massiver new fee to even start down the to resolve unpaid said Wade Vose, a partner at the Winter Park-basecd .
All real estate-related cases — including construction liens, boundary disputes betweenm property owners and other dispute over realestate — will be Vose said. The sliding-scale fees, depending on the valuew of the property ormortgage claim, mean someonre filing a claim on propertu or a mortgage valued at: $50,000 or less will pay $50,001 to $250,000 will pay $900. $250,001 or more will pay The same rates apply to anyone filinva counterclaim, counterpetition or third-party complaint for any real estate-related The higher fees may deter new case filings by thoser who can’t afford the increased costs, said And although most cases will get filesd regardless of the fees, increasing the cost may make some people feel their acces s to the courts is limited, he Ed Loos III, a partner and shareholder in the Orlandp office of Fort Lauderdale-basefd Greenspoon Marder, said the new fees shouldn’ deter mortgage lenders from filing because, in the end, a $1 ,909 fee is outweighed by a $250,000 or more claim, and the fee will be includecd in the judgment.
Van Bogan, chief executivr officer of , said the changes won’t stop his bank from filing a claim. However, the fee increase will be a short-term fix to the state’se budgetary problems because foreclosure filings will drop once the market recovers, Bogan said. Until then, “the consumer will bear the brunytof it.” Added Vose: “Part of the way real estate corrects itself is through litigation of thesed issues, and the fees seem counterproductivr to helping work out the real estate imbalance in Florida.

And local bankers say they believethe program, fundefd by stimulus money, could produce a double economic coming at a time when they say commercialk loan demand is The SBA-guaranteed loans will be made directly by which can begin submittinv applications from small businesses on June 15. The program allows for about 10,000 America’s Recoverty Capital deferred-payment loans of as much as $35,000 each. That amoun t is far less than the typical SBA loan.
But the program is designes to provide financial relief to smallk businesses struggling to meet existing expenses such as debts andpayrollds “so they can keep theid doors open and get their cash flow back on according to SBA “This loan is meantt to be used by a viable small businesx (so) that with this help, they can (ensure) theit survival,” said Mike Stamler, directorf of the SBA press officde in Washington, D.C.
Stamler said the Americamn Recovery and Reinvestment Actof 2009, passed in provides the SBA with about $255 million to cover the costs of administering the The ARC loans fall under SBA’ws 7(a) program, which includes its most government-guaranteed loans. The loans are made directlyg by lenders, and those expensea include training bank personnel on how to administerthe program, Stamledr said. Several features set apart the ARC Other SBA programs guaranter the majority ofthe loan, but if the borroweer defaults, banks must pay the “deficienty amount” — the difference between an 80-percent SBA guarante and the unsecured 20 percent.
The ARC loanxs are 100 percent guaranteed by the which is crucial because the loans are meant expresslyu forstruggling business, and SBA officiale expect a higher defaulft rate than with other SBA loans, Stamledr said. Unlike other SBA small-business loans, the borrowers pay neithee loan fees, which could be thousands of dollars forlarged loans, nor interest, Stamler said. (See relatecd item at right.) ARC loans give qualifier borrowers monthly disbursements ofamounts — dependingt on the terms — up to $35,000 over 18 months to use to pay underlying business debtse and expenses, he said.
Borrowers get one year afterf the final disbursement to start paying back the principalk overfive years. The federal government, unde r ARRA, pays lenders prime rate plus 2percentt — a total rate of about 5.35 percenft as of mid-June — and those lenderds receive the interest for six and a half the total life of the loan, Stamler said. “These are attractivs terms,” he said. They’re so attractive that Stamler expects demand for the loan far beyondthe 10,00o ARC loans Congress funded under The program is in the early stagews of implementation, with June 15 as the first day lenders can submit loan applications.
Locakl SBA offices are just now beginning to train Stamler said. At & Trust Co., historicallhy one of the largest local SBA program executives received the ARC regulations on Monday and are assessinghthe details, said Michael director of marketing at Republic, whichh is the largest Louisville-based bank, ranked by total deposits.
